These terms constitute a legally binding agreement between you (the user) and NYC Bullion, LLC. Please read these Terms and Conditions carefully before proceeding. By using our website, creating an account, placing orders, or engaging in any business with NYC Bullion, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. This agreement applies to all transactions, including those made through the website, by phone, or via any other method.

• Purchasing Decisions: By using our website, you acknowledge that you are solely responsible for your purchasing and selling decisions. NYC Bullion does not offer investment advice or make recommendations regarding the purchase or sale of precious metals.
• Market Risks: The prices of precious metals can fluctuate, and purchasing or selling them involves risks. NYC Bullion is not responsible for any losses you may incur due to market fluctuations.

NYC Bullion does not provide financial or investment advice. Any content on our website is for informational purposes only and should not be interpreted as a recommendation to buy or sell. You assume full responsibility for any decisions made regarding the purchase or sale of precious metals. The value of these metals can fluctuate, and investments may result in financial loss.

To use certain features of the website or place an order, you must create an account. By registering an account, you represent that:

• You are at least 18 years of age.
• The information you provide is accurate and complete.
• You are responsible for maintaining the confidentiality of your account credentials (email, password, etc.).
• You are solely responsible for all activities under your account.

Communication: By creating an account or placing an order, you agree to receive emails or text notifications related to your orders. You may opt-out of marketing communications at any time by contacting our customer service team.

• Pricing: All prices listed on our website are in U.S. Dollars. Precious metal prices fluctuate based on market conditions, and the final price will be determined at checkout. Once in the checkout process, you have 3 minutes to finalize your order, after which prices may adjust.
• Errors: NYC Bullion reserves the right to correct any errors in pricing or product information. If an order is placed with an incorrect price or product description, we will notify you and may cancel the order at our discretion.

We accept various payment methods, including:

• Credit/Debit Cards (Visa, MasterCard, Discover): Transactions are limited to $10,000.
• PayPal: Orders up to $10,000.
• Wire Transfers: Orders between $2,000 and $750,000.
• Checks and eChecks (ACH): Orders over $300 and up to $25,000.

Due to the volatility of the bullion market, all precious metal sales are final once an order is placed and confirmed. Cancellations or modifications are not allowed. If a customer insists on canceling an order:

• A 10% fee will be applied for credit card, debit card, or PayPal orders.
• Market loss fees may also apply, and you will be liable for any market losses incurred by NYC Bullion.

• Shipping Methods: NYC Bullion ships using USPS, UPS, and FedEx within the United States (excluding Hawaii and Puerto Rico). Shipping is free for orders over $199. Orders under $199 will incur a flat rate of $7.99.
• Processing Time: In-stock items are typically shipped within 5 business days of receiving cleared payment. Shipping times may be extended during high-volume periods or holidays.
• Insurance: All shipments are insured free of charge while in transit.
• Delivered Not Received: Once the tracking information shows that a package has been delivered, NYC Bullion is no longer responsible for the package.

When placing an order with NYC Bullion, you are entering into a binding agreement. Once your order is placed, you cannot cancel or modify it without incurring fees or penalties. We may require a deposit of 10% for check or wire transfers to lock in your price, and the remaining balance must be paid within three (3) business days.

NYC Bullion takes fraud seriously and complies with anti-money laundering (AML) regulations. We may require additional documentation for verification purposes before processing an order. Any fraudulent orders will be reported to the appropriate authorities, and we reserve the right to refuse or cancel orders that appear suspicious.

Returns, exchanges, or refunds are allowed within seven (7) days of receiving the product, subject to approval by our customer service team. Restocking fees of 10% apply to all returns, and additional fees may be assessed for market losses.

To initiate a return, please contact customer service within seven (7) business days of receiving your order at sell@nycbullion.com.

By placing an order, you agree not to file a chargeback with your bank or credit card issuer. If a chargeback is filed, you will be responsible for all fees associated with investigating and responding to the chargeback.

You agree to indemnify and hold harmless NYC Bullion and its affiliates, employees, and representatives from any claims, damages, or costs arising out of your use of this website or violation of these terms.

NYC Bullion is not liable for any delays or failures to perform due to events beyond our reasonable control, including but not limited to natural disasters, war, acts of terrorism, labor disputes, or government actions.

NYC Bullion reserves the right to suspend or terminate your account or access to the website at our sole discretion, without notice, for any reason, including suspected fraud or violations of these Terms and Conditions.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
